i. Privacy policy.
Evolve Agentic (the firm) collects, processes, and stores information from visitors and clients in the course of operating its website and delivering services. This policy explains what we collect, why, and what control you have over it.
What we collect
- Information you provide directly: name, email, company, phone, project details submitted through forms or shared during calls.
- Technical information: IP address, browser type, device type, pages visited, and referring URL collected through standard server logs and privacy-respecting analytics.
- Client engagement data: access credentials, project documents, and system data necessary to deliver contracted services. This is treated as confidential.
How we use it
- To respond to inquiries and deliver services you have engaged us for.
- To improve the site, content, and our processes.
- To send transactional communications (project updates, invoices, support).
- To send occasional non-transactional communications (newsletter, insights) only if you have opted in.
What we do not do
- We do not sell your information to third parties.
- We do not use client data to train AI models, ours or anyone else's.
- We do not run intrusive third-party tracking. Analytics tooling is privacy-respecting where available.
Third-party services we rely on
We use third-party tools (hosting, email delivery, payment processing, scheduling, analytics, AI APIs) to operate. Each has its own privacy practices. A current list of subprocessors is available on request.
Data retention
We retain client engagement data for the duration of the engagement plus the 1-year support window, after which it is destroyed within 30 days unless you request earlier deletion or longer retention. Marketing data is retained until you opt out.
Your rights
You can request access to, correction of, or deletion of your data at any time by emailing legal@evolveagentic.ai. We respond within 30 days. Where applicable, GDPR and CCPA rights apply.
Cookies
We use essential cookies only. We do not run advertising trackers or third-party cookies that build profiles across the web. If this changes, we will update this policy and add a cookie notice.
ii. Terms of service.
These terms govern your use of the Evolve Agentic website and any services you engage us for. Engaging our services additionally requires a signed Statement of Work (SOW) or Master Services Agreement (MSA), which supersedes general terms where they conflict.
Services
We provide platform implementation, agentic intelligence, custom software, and related advisory services. The specific scope of any engagement is defined in the SOW you sign. Nothing on this website constitutes a binding offer until both parties countersign an SOW or MSA.
Acceptable use of the website
- You may use the site for lawful, non-commercial information purposes.
- You may not scrape, abuse, attack, or attempt to gain unauthorized access to the site or its systems.
- You may not impersonate the firm, copy the brand for commercial use, or reproduce site content in a way that misrepresents authorship.
Intellectual property
Site content (copy, design, logos, code examples) is owned by Evolve Agentic. Deliverables produced during a paid engagement are governed by the IP terms in your SOW. Default: you own the working deliverables; we retain rights to reusable methods, templates, and tooling we built before or outside your engagement.
Confidentiality
We treat client information as confidential. We sign mutual NDAs before paid engagements begin. We will not disclose client identity, project details, or proprietary information without written consent.
Warranties & limitations
We deliver services with reasonable professional care. We do not warrant outcomes (revenue, conversions, business results) because those depend on factors outside our scope. Our liability for any engagement is limited to the fees paid for that engagement, except in cases of gross negligence or willful misconduct.
Governing law
These terms are governed by the laws of [state pending], United States. Disputes will be resolved through good-faith negotiation first, then binding arbitration, then court only as a last resort.
iii. Refund policy.
We believe in clear, upfront refund terms. Different engagement types follow different rules.
Free fit call
The 15 to 30 minute fit call is free. No payment, no refund applicable.
Paid scoping consultation ($500)
The $500 scoping consultation is non-refundable. It is credited toward any engagement you book within 60 days. If we conclude on the call that we are not the right fit, the $500 covers our preparation, the live audit, and the written recommendation, all of which retain value.
Productized installs
50% deposit on signed SOW, 50% on accepted delivery. If we fail to deliver against the acceptance criteria in the SOW after a reasonable revision period, you receive a full refund of unearned amounts. If you cancel after we have begun work, the deposit is non-refundable, but unstarted work is removed from your invoice.
Scoped projects
Same 50/50 structure as productized installs. For larger scoped projects (over $25K), we may agree on three or four milestone payments to reduce upfront exposure for both sides. Each milestone has its own acceptance criteria. Missed milestones on our side trigger pro-rated refunds.
Custom software & retainer (T&M)
Time and materials work is billed in arrears. You only pay for hours already worked. If a project is canceled mid-engagement, you pay for work completed up to the cancellation date and we release deliverables in their current state. Retainers run on rolling-month commitment with two weeks notice to cancel.
Acceptance & revisions
Every deliverable has an acceptance period (typically 7 to 14 days, defined in SOW) during which you can request revisions against the acceptance criteria. Revisions inside scope are included. Revisions outside scope are quoted as a change order before any new work begins.
How to request a refund
Email legal@evolveagentic.ai with your engagement details and reason. We respond within 5 business days. Approved refunds are processed within 14 business days to the original payment method.
